These Terms govern the use of kiosko by businesses that create a catalog ("Merchants") and by people who buy or book on a catalog ("Buyers").
The platform does not sell, manufacture, or provide the products or services listed on any catalog. Each Merchant is solely responsible for the quality, legality, description, delivery, and warranty of what they offer.
Every purchase or booking made through a catalog forms a contract exclusively between the Buyer and the corresponding Merchant — the platform is not a party to that contract and is not responsible for its fulfillment.
Money from a purchase goes directly from the Buyer to the Merchant, through the payment provider the Merchant has connected or via cash on delivery. The platform never receives, holds, or transfers those funds.
Using the admin panel may require a recurring subscription (Pro plan), billed by our subscription payment provider acting as merchant of record. The billing terms — auto-renewal, cancellation — are the ones shown at the time of subscribing.
The Merchant represents that they have the right to sell what they list, that their catalog information is truthful, and that they comply with the regulations applicable to their business, including personal data protection for their own Buyers.
The Merchant is responsible for keeping their account confidential and for all activity that occurs under it.
The platform is provided "as is", without a guarantee of uninterrupted availability. To the extent permitted by law, we are not liable for damages arising from a transaction between a Merchant and a Buyer, nor for content published by a Merchant.
We may update these Terms. Material changes will be announced with reasonable notice; continued use of the platform after a change means acceptance of it.
